RSYC provides online services to you subject to the following Terms & Conditions ("T&C"). By accessing the website of RSYC and/or using the online services, you agree to be bound by the T&C. RSYC reserves the right to change these T&C from time to time. Amendments will be effective immediately upon notification on this website. Please review these T&C from time to time so that you will be apprised of any changes. If you do not agree to any of the T&C, please immediately discontinue your access.

(a) Definitions

1. "RSYC" and "we" refer to Republic of Singapore Yacht Club
2. "this website" refers to Republic of Singapore Yacht Club's official website (URL: www.rsyc.org.sg)
3. "online services" refers to the services that are offered to RSYC members via the website e.g. online facilities booking, member's account enquiries etc.

(b) You agree to comply with all procedures, requirements or restrictions relating to the access and use of the online services, which RSYC may post online at this website from time to time.

(c) You are responsible for data accuracy and relevance and must have the authority to disclose any data you either submit to this website directly or include in any message to us for the purpose of any transaction concluded for or by you through this website.

(d) You agree that all applications using your password whether authorised by you or not are irrevocable and binding on you. RSYC shall be entitled to act on such applications without any further reference to you and notwithstanding any error, fraud, forgery, ambiguity or misunderstanding.

(e) You agree that you are fully responsible for the security of your password(s) and agree to keep confidential and safeguard all password(s) used by you. You agree to notify us immediately if the security of your password has been compromised.

(f) RSYC is entitled to deactivate your password at any time, without giving any reason without prior notice to you and without any liability to you whatsoever.

(g) You agree that RSYC shall not be liable for any damages, losses, expenses or costs whatsoever (whether direct or indirect, whether foreseeable or not) suffered or incurred by you in connection with any information provided by you for facilities booking(s) made with your password.

(h) You understand that any transaction made using your password may not be received by us for whatever reason beyond our control. Unless you receive complete and accurate notification of receipt from us, any transaction may not be accepted by or acted on by us. In such event, you agree that RSYC shall not be liable for any damages, losses, expenses or costs whatsoever (whether direct or indirect, whether foreseeable or not) suffered or incurred by you.

(i) You agree to notify us immediately if you receive incomplete or inaccurate data or information from us. You agree to notify us immediately upon receipt of any data or information, which is not intended for you. All such data or information must be deleted from your computer system immediately.

(j) You acknowledge and agree that we may, without notice, at any time and from time to time add to, vary, alter, suspend or remove any of the online services or part of it without giving any reason and without incurring any liability to you or to any third party.

(k) We are under no obligation to honour any transactions and may cancel them without incurring any liability whatsoever, including and without limitation if:

1. We know or have reason to believe that a fraud, criminal act, offence or violation of any law or regulation has been or will be committed.
   
2. We know or have reason to believe that any of the confirmation or information which you have furnished to us in connection with the online services is wrong or incorrect at the time of application.

(l) You agree to use this website only for lawful purposes, and in a manner which does not infringe the rights, or restrict, or inhibit the use and enjoyment of the website by any third party. You agree not to e-mail, post, upload, transfer to this website, or otherwise make available any material which:-

1. is obscene, misleading, inaccurate, defamatory, illegal, confidential, libellous or otherwise objectionable;
2. is in breach of any copyright or other intellectual property rights of any party;
3. contains software viruses or any other computer code, files or programmes designed to damage, interrupt,destroy or limit the performance of our or any other parties' computer system (both software and hardware);
4. may constitute or encourage conduct that would constitute a criminal offence, liability or otherwise violate law.You agree to indemnify us in respect of any liability, loss, expense, or other costs whatsoever incurred because of a breach of your obligation under this paragraph including, but not limited to, any claims made against us by any third parties.

We disclaim all warranties, express or implied, statutory or otherwise, including but not limited to warranties of non-infringement of third party intellectual property rights, merchantability, satisfactory quality, acceptable quality and/or fitness for a particular purpose. We do not warrant that access to this website or use of our online services will be uninterrupted, error-free, bug-free, and free from computer virus and other malicious code or that defects will be corrected.

(s) You acknowledge that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright and trademarks) in this website belongs to RSYC. Accordingly, any part of this website (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of displaying on your computer screen and printing it out on your printer for the sole purpose of viewing its content.

(t) You may not link this website from any other website or use any trademark or logo or other proprietary trademark without our prior written consent. You agree that we shall take no responsibility for any loss or damage caused by or in connection with use of or reliance of the contents or goods or services available on or through any such third party websites or resource.

(u) You shall pay any GST or any other tax levies or bank charges whatsoever imposed by law or required to be paid in connection with the subscription fees paid or your use of the online services.

(v) RSYC may, without incurring any liability whatsoever to you or any third party, in our absolute discretion, terminate, deactivate or revoke your use of the online services without giving any reason at any time and without giving any prior notice to you. Your obligation to pay all fees or charges up to the date of termination shall survive.

(w) Responsibility for the content of advertisements appearing on this web site (including hyperlinks to advertisers' own web sites) rests solely with the advertisers. The placement of such advertisements does not constitute a recommendation or endorsement by us of the advertisers' products and each advertiser is solely responsible for any representation made in connection with its advertisement.
